Terms of service

These Terms of Service apply when you visit or purchase from the TesMate online store. TesMate is operated by Jianwei Zhang, a sole trader trading as TesMate, ABN 85 426 612 643. We operate an online store in Australia and deliver to Australian addresses only. By using the store or placing an order, you agree to these terms and any policies linked from them.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL). If these terms are inconsistent with a non-excludable right, that right prevails.

Store use and accounts

You must provide accurate, current information when placing an order or creating an account. You are responsible for keeping account credentials confidential and for activity you authorise through your account. You must not misuse the store, interfere with security, introduce malicious code, scrape the store at unreasonable volume, infringe another person's rights or use the store for unlawful purposes.

Product information and compatibility

We take reasonable care to describe products accurately. Colours and appearance may vary slightly because of screens, lighting, manufacturing batches and vehicle production changes. Measurements are approximate unless stated otherwise.

Vehicle compatibility can depend on model, model year, configuration, build location and factory updates. Please read all compatibility notes and contact us before ordering if unsure. If you select an incompatible item despite accurate compatibility information, our change-of-mind return conditions apply. If our description or compatibility information is incorrect or misleading, your ACL rights apply.

Orders and acceptance

An order confirmation acknowledges that we received your order and sets out the order details submitted. Before dispatch, we may need to decline or cancel all or part of an order on reasonable grounds, such as suspected fraud, an obvious pricing or description error, stock unavailability, payment failure or delivery restrictions. We will notify you as soon as reasonably practicable. If TesMate cancels the whole order after payment, we will refund all amounts paid for that order to the original payment method. If we cancel only part, we will refund the cancelled item and any delivery charge that no longer applies. A cancellation initiated by TesMate is not a change-of-mind return, so no restocking fee or return shipping charge applies to the cancelled item. Nothing in this section limits any non-excludable right under the Australian Consumer Law.

You may request a change or cancellation before dispatch. We will try to assist but cannot guarantee changes once fulfilment has started.

Prices and payment

All prices and payments are in Australian dollars (AUD). Applicable charges, including delivery, are shown at checkout before payment. TesMate is currently not registered for GST and does not charge GST. We may correct genuine pricing errors before accepting an order and will give you the choice to proceed at the correct price or receive a refund.

Payment is processed by Shopify or the payment method selected at checkout. You confirm that you are authorised to use the payment method supplied.

Shipping, returns and refunds

Our Shipping Policy explains delivery charges and estimated processing and transit times. Our Return and Refund Policy explains change-of-mind returns, exchanges and remedies for faulty, damaged, incorrect or misdescribed goods. Please read these policies before ordering. Nothing in these policies limits your non-excludable rights under the Australian Consumer Law.

Independent retailer

TesMate is an independent retailer and is not affiliated with, endorsed by or sponsored by Tesla, Inc. References to Tesla vehicles identify product compatibility, not manufacture by Tesla. Product brands are identified in the relevant product information.

Shopify and personal information

Our store is hosted by Shopify. Shopify collects and processes personal information when you visit and make purchases from our store. We use Shopify Network Intelligence and Enhanced Services that help protect, grow and improve our business using information from your interactions with our store, other merchants and Shopify. Your information is shared with Shopify and service providers that may be located outside Australia, including in the United States, to provide these services.

Our Privacy Policy explains our personal information practices. You can read the Shopify Consumer Privacy Policy and use the Shopify privacy portal to learn about and exercise applicable rights, including withdrawing consent or objecting to processing where those rights apply.

Governing law

These terms are governed by the laws of New South Wales, Australia, subject to any mandatory laws and consumer rights that apply to you. Nothing in this clause excludes or restricts rights or remedies that cannot lawfully be excluded.
